Of course there's controversy over the photo, because the website was registered NOT by Warner Brothers, but by a well-known spam site. If you're interested, check the TalkBacks at AICN to see the research that was done.
To me, it just looks like a really crappy Photoshop of Heath's face and not a picture of him in makeup.
That said, I hope that this is the direction they're gonna go with the character. I much prefer the idea of a psychopath who disfigures himself to look like a clown rather than the cartoony Jack Nicholson character design.
